PROHOSTIVA

Terms of Service

Last updated: 12 October 2026

Related: Privacy Policy · Cookie Policy

1. Introduction

These Terms of Service ("Terms") govern the use of hosting and related services provided through ProHostiva ("ProHostiva", "we", "us", or "our").

By creating an account, purchasing a ProHostiva service, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, you must not purchase or use ProHostiva services.

These Terms apply to both consumers and customers acting for purposes related to their business, trade or profession. Where mandatory consumer protection laws provide additional rights to consumers, those rights remain unaffected by these Terms.

2. Provider Information

ProHostiva is currently operated by:

Aleksandra Stoycheva
Natural person established in Bulgaria
ul. Nayden Gerov 60, Gabrovo
Bulgaria

Contact email: legal@prohostiva.com

ProHostiva is currently operated as a business activity of a natural person and is not presented as a separate legal entity unless and until a separate legal entity is established.

3. Services

ProHostiva provides website hosting and related technical infrastructure services.

Depending on the plan and features available at the time of purchase, the services may include:

  • hosting of websites and web applications;
  • storage of website files and related data;
  • allocation of network bandwidth;
  • deployment and operation of supported applications;
  • provision of a ProHostiva subdomain where applicable;
  • technical infrastructure and server resources;
  • automated or manual deployment functionality;
  • other features expressly described on the ProHostiva website or within the customer's account.

ProHostiva does not currently provide domain registration as a reseller service.

Customers may purchase and manage their own domains through third-party domain providers. Where a customer does not have their own domain, ProHostiva may provide a ProHostiva subdomain for the hosted service.

ProHostiva does not currently provide domain-based email registration as part of its hosting plans.

Free setup help

Every plan includes free help getting a website online. When a customer asks for it, ProHostiva may:

  • publish the website on the customer's behalf;
  • configure platform settings, such as environment variables, the start command, the runtime version and custom domains, for any website regardless of how it was provided;
  • for websites provided as a ZIP upload only, change the website's code where needed to fix problems that stop it from building or running, such as those reported by the readiness check, and return the updated ZIP to the customer so that later uploads keep the change.

For websites published from a GitHub repository or built with an AI tool, ProHostiva does not change the code and does not request access to the customer's repository. Instead, ProHostiva may explain what needs to change, including an instruction the customer can give to their AI tool or developer. The customer makes the change and publishes again.

Free setup help does not include editing website content, text, images or design, adding features, or ongoing maintenance or development of the customer's website. Changes made as part of setup help do not transfer responsibility for the website to ProHostiva (see section 22). Setup help is provided on a reasonable-efforts basis, and ProHostiva may decline a request that falls outside this scope.

Paid build services

ProHostiva also offers website building and Framer rebuilds as separate, one-off paid services, quoted per project. They are governed by section 35 in addition to these Terms.

We may introduce, modify or discontinue particular features or services, provided that such changes do not unlawfully affect services already paid for or mandatory consumer rights.

4. Hosting Plans and Resource Limits

Starter

  • 1 hosted website;
  • 10 GB storage;
  • 100 GB monthly bandwidth.

Business

  • up to 5 hosted websites;
  • 30 GB storage;
  • 300 GB monthly bandwidth.

Agency

  • up to 15 hosted websites;
  • 60 GB storage;
  • 750 GB monthly bandwidth.

The current price of each plan, paid monthly, every six months or yearly, is shown on the pricing page and again before the customer pays.

Resource limits apply to the relevant subscription and may be technically enforced by ProHostiva.

Customers must not circumvent, disable or attempt to bypass technical resource restrictions.

Support

Support is by email. We aim to answer within two business days on Starter, by the next business day on Business, and on the same business day on Agency, for messages received by 15:00 Bulgarian time. These are targets, not guaranteed response times.

Plan limits

Each plan includes a number of websites, an amount of storage and a monthly amount of bandwidth, as shown on the pricing page. Storage and bandwidth are counted for the customer's whole account across all their websites, within each usage month. On a monthly plan the usage month is the billing period; on a six-monthly or yearly plan, the paid period is divided into six or twelve usage months, each with the plan's full monthly allowance, and unused allowance does not carry over to the next month. Bandwidth is the network traffic of the customer's websites; storage is the disk space their websites use, including files they create while running.

Going over

We will email the customer when they reach 80% and 100% of a limit. The customer's websites stay online if they go over. If usage goes above 120% of a limit, the customer will not be able to deploy new versions of their websites until they upgrade their plan, buy extra allowance, or their next usage month starts. We never charge for extra usage automatically.

Extra allowance

The customer can buy extra bandwidth or storage from the Billing page for a one-time price shown before they pay. Extra allowance applies from the moment payment is confirmed until the end of the current usage month, does not carry over, and does not renew.

Repeated overuse

If an account goes over its plan limits in several usage months in a row, we may contact the customer and, with at least 14 days' notice, move them to a plan that fits their usage.

If a customer's requirements exceed the limits of their current plan, the customer may also upgrade to another available plan at any time.

Plan availability, pricing and included resources may change for future purchases or renewals, subject to the provisions concerning existing subscriptions and applicable consumer law.

5. Accounts

Certain ProHostiva services require the customer to create an account.

The customer is responsible for:

  • providing accurate information;
  • maintaining the security of their account;
  • keeping login credentials confidential;
  • notifying ProHostiva of suspected unauthorized access;
  • ensuring that activities performed through their account comply with these Terms and applicable law.

The customer must not knowingly allow another person to use their account in a manner that violates these Terms.

ProHostiva may take reasonable measures to protect an account where unauthorized access or abuse is suspected.

6. Subscriptions and Billing

ProHostiva hosting plans are provided as subscriptions, billed monthly, every six months or yearly as the customer chooses before paying. A monthly subscription is paid at the start of each month. A six-monthly subscription is paid in advance for six months, at six times the monthly price. A yearly subscription is paid in advance for twelve months at the yearly price, which may be lower than twelve monthly payments.

Subscription payments are processed through Stripe.

By purchasing a subscription, the customer authorizes the applicable recurring charge for the selected plan.

ProHostiva does not store customers' full payment card details. Payment card information is processed by Stripe in accordance with Stripe's own terms and policies.

The applicable subscription price is displayed before the customer completes the purchase.

Unless otherwise stated, prices are expressed in euros.

7. Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the next renewal.

The subscription will be charged at the applicable price for the next billing period: a month for a monthly subscription, six months for a six-monthly subscription, a year for a yearly subscription.

Before a yearly subscription renews, the customer will be sent a reminder by email with the renewal date and amount, so they can cancel in time if they wish.

The customer may cancel their subscription at any time through the available account controls or by contacting ProHostiva.

Cancellation prevents the next automatic renewal but does not normally terminate the already-paid billing period.

The service will remain available until the end of the current paid billing period, unless it is suspended or terminated for another reason permitted by these Terms.

8. Cancellation

Customers may cancel their subscription at any time.

Cancellation:

  • prevents the next automatic renewal;
  • does not normally result in a refund for the current billing period, including the remaining months of a six-monthly or yearly subscription;
  • allows the service to remain active until the end of the current paid billing period.

Cancellation of a subscription is separate from exercising a statutory consumer right of withdrawal.

Consumers retain any mandatory rights provided by applicable law.

9. Consumer Right of Withdrawal

If the customer is a consumer and the applicable law grants a statutory right of withdrawal, the customer may generally withdraw from a distance contract within 14 days, subject to applicable legal exceptions.

Immediate commencement of service

Because hosting services may need to become operational immediately after purchase, the customer may expressly request that ProHostiva begins providing the service before the expiry of the 14-day withdrawal period.

Where legally required, the customer will be asked to expressly acknowledge the consequences of requesting immediate performance.

If the customer validly exercises their right of withdrawal after expressly requesting that the service begin during the withdrawal period, ProHostiva may be entitled to receive a proportionate amount corresponding to the service provided up to the time the withdrawal is communicated, to the extent permitted by applicable law.

Extra allowance

Extra bandwidth or storage bought from the Billing page (see section 4) starts immediately at the customer's express request. By asking for it to start straight away, the customer acknowledges that they lose their right to withdraw from that purchase once it has been applied to their account.

Nothing in these Terms limits any mandatory statutory consumer rights.

10. Refunds

Except where a refund is required by applicable law or expressly provided by ProHostiva, subscription payments are generally non-refundable once the relevant service period has begun.

This does not affect:

  • statutory consumer rights;
  • valid exercises of the right of withdrawal;
  • refunds resulting from billing errors;
  • refunds expressly approved by ProHostiva;
  • other refunds required by applicable law.

Where a consumer validly exercises their right of withdrawal after requesting immediate commencement of the service, any refund will be calculated in accordance with the applicable legal requirements, including any permitted proportionate charge for services already provided. For a six-monthly or yearly subscription, that proportionate charge is based on the price actually paid for that period.

Approved refunds will generally be processed through the original payment method used for the transaction.

11. Failed Payments

If a recurring payment fails, ProHostiva may notify the customer and attempt to collect the outstanding amount through the applicable payment provider.

Following a failed payment:

  1. The affected service may remain active for up to 3 days.
  2. If payment remains outstanding after this initial period, ProHostiva may suspend the affected service.
  3. If the outstanding amount remains unpaid for 27 days from the original failed payment, ProHostiva may terminate the affected service and begin the deletion process described below.

ProHostiva may restore suspended services after successful payment where technically possible.

Customers remain responsible for outstanding charges incurred before termination.

12. Suspension for Non-Payment

During suspension:

  • the hosted website may become inaccessible;
  • deployment and related service functionality may be disabled;
  • the customer's data may remain stored temporarily;
  • the customer may be required to settle outstanding charges before restoration.

Suspension does not automatically constitute permanent deletion.

13. Customer Content

Customers retain ownership of the content they upload, deploy or otherwise provide through ProHostiva.

Customer Content may include:

  • source code;
  • website files;
  • images;
  • text;
  • databases;
  • configuration data;
  • application data;
  • other materials supplied by the customer or generated through the customer's application.

The customer grants ProHostiva the limited rights necessary to store, process, transmit, reproduce and technically operate Customer Content solely for the purpose of providing the contracted services.

ProHostiva does not acquire ownership of Customer Content.

The customer is responsible for ensuring that their content and use of the services comply with applicable law and do not infringe the rights of third parties.

14. Acceptable Use

Customers may use ProHostiva services only for lawful purposes.

The following activities are prohibited:

  • phishing or credential theft;
  • malware distribution;
  • viruses, trojans, ransomware or other malicious software;
  • operating botnets;
  • unauthorized access to systems or accounts;
  • attempting to compromise or attack networks or infrastructure;
  • denial-of-service attacks or similar abusive activity;
  • spam or unauthorized bulk messaging;
  • fraudulent or deceptive activity;
  • hosting content that is unlawful under applicable law;
  • copyright or trademark infringement;
  • distribution of stolen credentials or personal data without lawful authorization;
  • cryptocurrency mining or substantially similar resource-intensive activity unless expressly authorized;
  • deliberate circumvention of hosting resource limits;
  • activities that materially interfere with other customers or the ProHostiva infrastructure;
  • using ProHostiva services to facilitate illegal activity.

This list is not exhaustive.

ProHostiva may take reasonable action where a customer's use of the service presents a security, legal, operational or abuse risk.

15. Suspension or Termination for Abuse

ProHostiva may suspend or terminate a service where reasonably necessary to:

  • prevent ongoing abuse;
  • protect the infrastructure;
  • protect other customers;
  • respond to malware, phishing or security incidents;
  • comply with legal obligations;
  • prevent serious violations of these Terms.

Where reasonably possible, ProHostiva may first notify the customer and provide an opportunity to remedy the violation.

Immediate suspension may be necessary where prior notice could increase the risk of harm, compromise, abuse or legal exposure.

Where appropriate, ProHostiva may request information or corrective action from the customer before restoring a suspended service.

16. Domains and DNS

Customers are responsible for domains they purchase through third-party providers.

The customer is responsible for:

  • domain registration;
  • domain renewal;
  • ownership and registration information;
  • nameservers;
  • DNS configuration;
  • compliance with the terms of the relevant domain registrar.

ProHostiva does not currently act as a domain registrar or domain reseller.

Where a customer does not have their own domain, ProHostiva may provide a subdomain under a ProHostiva-controlled domain.

Provision of a ProHostiva subdomain does not transfer ownership of the underlying domain to the customer.

17. Backups

ProHostiva makes a backup of the platform every night, for disaster recovery. It includes the website files uploaded to ProHostiva, each website's settings, environment variables and connected domains, and account and billing data. It is stored on a separate storage volume within our hosting infrastructure.

Backups are kept for up to about six months: one for each of the last seven days, one for each of the last four weeks, and one for each of the last six months. Older backups are deleted automatically.

Backups do not include data a website writes while it runs (for example files uploaded by its visitors, or a database stored inside the website), because this data is not kept between deployments. Websites deployed from GitHub can also be rebuilt from their repository.

Backups exist to restore the platform after a failure. On request, and where technically feasible, ProHostiva may also help restore an individual website from a backup.

Unless expressly stated otherwise:

  • backups are not guaranteed to be complete or error-free;
  • backups may occasionally fail;
  • backups may become unavailable or corrupted;
  • customers do not have direct self-service access to backups;
  • restoration is subject to technical feasibility.

Customers remain responsible for maintaining their own copies of important data.

ProHostiva should not be treated as the customer's sole backup solution.

18. Service Availability and Maintenance

ProHostiva aims to provide reliable and continuous hosting services.

However, unless a separate written Service Level Agreement expressly provides otherwise, ProHostiva does not guarantee a specific uptime percentage.

The underlying infrastructure may depend on third-party providers and networks.

Service interruptions may occur due to:

  • scheduled maintenance;
  • emergency maintenance;
  • infrastructure failures;
  • network outages;
  • third-party provider failures;
  • security incidents;
  • force majeure;
  • circumstances outside ProHostiva's reasonable control.

Where reasonably possible, ProHostiva will attempt to perform planned maintenance in a manner that minimizes disruption.

19. Third-Party Services

ProHostiva may rely on third-party providers to operate its services.

These may include providers of:

  • payment processing;
  • cloud and server infrastructure;
  • DNS and domain-related services;
  • email delivery;
  • source-code integrations;
  • other technical infrastructure.

Third-party services may be subject to their own terms, policies and availability.

The current use of third-party providers is described in the ProHostiva Privacy Policy.

20. Intellectual Property

ProHostiva and its licensors retain all rights in:

  • the ProHostiva software and platform;
  • ProHostiva's website;
  • ProHostiva branding and trademarks;
  • platform architecture;
  • user interface and design;
  • documentation;
  • proprietary tools and systems;
  • other materials created or provided by ProHostiva.

These Terms do not transfer ownership of ProHostiva intellectual property to customers.

Customers retain ownership of their own Customer Content, subject to the limited rights necessary for ProHostiva to provide the services.

21. Privacy and Personal Data

ProHostiva processes personal data in accordance with its Privacy Policy.

Where ProHostiva processes personal data on behalf of a customer in connection with a hosted website or application, the parties may also be subject to a separate Data Processing Agreement (DPA).

The customer remains responsible for determining the lawful basis and purposes for personal data processed through their own website or application where the customer acts as controller.

ProHostiva will process customer-provided personal data only as necessary to provide the relevant services and in accordance with the applicable contractual and data protection requirements.

22. Customer Responsibility for Hosted Applications

The customer is responsible for the applications, websites and services they deploy through ProHostiva.

This includes responsibility for:

  • application security;
  • passwords and authentication systems;
  • software dependencies;
  • application-level vulnerabilities;
  • content;
  • user-generated content;
  • personal data collected through the customer's application;
  • compliance with applicable laws;
  • obtaining necessary licenses and permissions.

ProHostiva provides hosting infrastructure and does not become responsible for the customer's application merely because it is hosted on ProHostiva infrastructure.

23. Account and Service Termination

A customer may terminate their subscription by cancelling it in accordance with these Terms.

ProHostiva may terminate a service where:

  • payment remains overdue in accordance with Section 11;
  • the customer materially violates these Terms;
  • continued service would violate applicable law;
  • continued service creates a serious security or infrastructure risk;
  • another legally valid reason for termination exists.

Where termination is based on a curable breach, ProHostiva will, where reasonably possible, provide the customer with an opportunity to remedy the breach.

Mandatory consumer rights remain unaffected.

24. Data Retention After Termination

Following termination of a hosting service, ProHostiva may retain the relevant hosted data for up to 30 days before permanent deletion.

This period is intended to provide a limited opportunity for administrative handling, account recovery or resolution of outstanding matters.

After the applicable retention period expires, ProHostiva may permanently delete:

  • hosted website files;
  • databases;
  • deployment data;
  • associated project data;
  • other service data associated with the terminated service.

Deletion may be irreversible.

Certain information may be retained for longer where required by law, for accounting, tax, fraud prevention, dispute resolution, security or other legitimate legal purposes.

Copies of deleted data in backups are removed as those backups are deleted, at the latest about six months after the deletion (see section 17).

25. Disclaimer of Warranties

To the maximum extent permitted by applicable law, ProHostiva provides its services on an "as available" basis.

ProHostiva does not guarantee that:

  • services will always be uninterrupted;
  • services will always be error-free;
  • every deployment will succeed;
  • hosted applications will be compatible with every software environment;
  • backups will always be available;
  • data will never be lost or corrupted.

Nothing in this section excludes or limits warranties or statutory rights that cannot legally be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, ProHostiva will not be liable for indirect, incidental, special or consequential losses arising from the use or inability to use the services.

This may include, where legally permissible:

  • loss of profits;
  • loss of business opportunities;
  • loss of anticipated savings;
  • loss of reputation;
  • indirect loss of data;
  • business interruption.

To the maximum extent permitted by applicable law, ProHostiva's aggregate liability arising from a customer's use of a paid service will not exceed the total fees actually paid by that customer to ProHostiva for the affected service during the 12 months preceding the event giving rise to the claim.

This limitation does not apply where liability cannot legally be limited or excluded.

Nothing in these Terms excludes or limits liability for matters that applicable law does not permit a provider to exclude or limit.

27. Customer Indemnification

To the extent permitted by applicable law, a customer may be responsible for claims brought by third parties arising from the customer's unlawful use of ProHostiva services or infringement of third-party rights through Customer Content.

This section does not require a consumer to compensate ProHostiva for liabilities that cannot lawfully be transferred to the consumer under applicable consumer protection law.

28. Changes to the Services

ProHostiva may modify or discontinue features of the services from time to time.

Changes may be necessary because of:

  • technical developments;
  • security requirements;
  • third-party provider changes;
  • legal or regulatory requirements;
  • operational considerations.

Where a change materially affects an existing paid service, ProHostiva will provide reasonable notice where required by applicable law.

29. Changes to These Terms

ProHostiva may update these Terms from time to time.

The updated version will be published on the ProHostiva website with a new "Last updated" date.

Where required by law, customers will receive appropriate notice of material changes.

Changes will not retroactively remove mandatory rights that apply to customers.

30. Governing Law

These Terms are governed by the laws of Bulgaria, without prejudice to mandatory consumer protection rules applicable to consumers in the European Union or in the consumer's country of residence where those rules apply.

Nothing in these Terms prevents a consumer from exercising rights granted by mandatory applicable law.

31. Dispute Resolution

ProHostiva encourages customers to contact legal@prohostiva.com first in order to resolve disputes informally.

Consumers retain any mandatory rights to bring claims before competent courts or use applicable alternative dispute resolution mechanisms.

Nothing in these Terms restricts mandatory consumer rights concerning jurisdiction or available legal remedies.

32. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible.

The remaining provisions will remain in effect to the extent permitted by law.

33. Entire Agreement

These Terms, together with the applicable Privacy Policy, DPA where applicable, and any additional service-specific terms expressly incorporated into the customer's agreement, constitute the agreement between the customer and ProHostiva concerning the relevant services.

Where there is a conflict between these Terms and mandatory applicable law, the mandatory law will prevail.

35. Website Build and Rebuild Services

This section applies when a customer orders a website build or a Framer rebuild (a "Build Service"), as described on the ProHostiva website. A Build Service is separate from hosting: it does not require a hosting plan, and a hosting plan does not include a Build Service.

Quote and contract

Each Build Service is quoted individually. The quote states the price, what is included (for example pages, content, forms and animations), the payment terms, the expected delivery time and the number of revision rounds. A contract for a Build Service is formed when the customer accepts the quote in writing, including by email. Requesting a quote is free and does not commit the customer to anything.

Work that is not described in the accepted quote, such as additional pages, features or changes after the agreed revision rounds, is quoted and agreed separately before it is carried out.

Price and payment

The price is the one stated in the accepted quote, in euros. Payment is due as set out in the quote, which may require full or partial payment before work begins. Hosting is billed separately under the customer's hosting plan, if any.

What the customer provides

The customer is responsible for providing, on time:

  • for a Framer rebuild, the address of the published Framer website to be rebuilt;
  • the text, images, logos and other materials to be used on the website;
  • answers and feedback needed to complete the work.

The customer confirms that they own, or have the right to use, the website, content and materials they provide, including any Framer template or design, and that rebuilding or using them does not infringe the rights of others. ProHostiva may decline or stop work where it reasonably believes this is not the case. Delays in receiving materials or feedback extend the expected delivery time accordingly.

Build Services with a prepaid plan

A customer who pays for a hosting plan at least six months in advance (six-monthly or yearly) can order a Framer rebuild, and a customer who pays yearly can order a website build, at the reduced price shown on the ProHostiva website for that plan when they order. The reduced price is a separate Build Service under this section, not part of the hosting subscription. If that subscription ends before the Build Service is delivered, the Build Service continues at its regular price unless the customer cancels it as described below.

Framer rebuilds

Framer does not offer an export of a website's code. A Framer rebuild is a new website that recreates the design, pages and content of the customer's published Framer website; it is not a copy of Framer's software or code. Some effects specific to Framer may be implemented differently. Known differences are described in the quote. ProHostiva is not affiliated with Framer.

Delivery, review and acceptance

Before delivery, ProHostiva provides a preview of the website for the customer to review. The customer may request corrections within the revision rounds stated in the quote. The work is accepted when the customer confirms it, or if the customer does not report problems within 14 days after the preview is provided, unless the quote states otherwise.

Delivery times in a quote are good-faith estimates, not fixed deadlines, unless the quote expressly states a fixed deadline.

Ownership of the delivered code

On delivery, ProHostiva provides the source code of the website as a ZIP file. Once the price has been paid in full, the customer owns the code written by ProHostiva for that website and may use, change, host and distribute it without restriction, including on other hosting providers.

Third-party components included in the website, such as fonts, open-source libraries, icons or stock images, remain subject to their own licences. ProHostiva will identify components with licence conditions that the customer needs to be aware of. Content provided by the customer remains the customer's.

ProHostiva may reuse general know-how, techniques and generic code that are not specific to the customer's website.

After delivery

A Build Service does not include ongoing maintenance, content updates or further development. If, within 30 days after acceptance, the customer reports that the delivered website does not work as described in the accepted quote, ProHostiva will correct it free of charge. Later changes can be quoted separately.

Once delivered, the customer is responsible for the website as a hosted application, as described in section 22.

Cancellation and right of withdrawal

Where a consumer has a statutory right of withdrawal, ProHostiva will only start work on a Build Service within the withdrawal period at the consumer's express request. If the consumer then withdraws, they pay a proportionate amount for the work carried out up to the time of withdrawal, to the extent permitted by applicable law. Where the consumer has acknowledged that they lose the right of withdrawal once the service has been fully performed, that right ends when the Build Service is fully performed.

Outside the statutory right of withdrawal, either party may cancel a Build Service in writing before delivery. In that case the customer pays for the work carried out up to the cancellation, and any payment made in advance beyond that amount is refunded.

36. Model Withdrawal Form

Consumers may use the following form to exercise their statutory right of withdrawal where applicable.
